Please take a moment to read the information below before submitting an inquiry for an original artwork. BIEZAART is not an online shop. Original artworks are offered for direct purchase through a personal inquiry and consultation process with the artist. When you click “Inquire to Purchase”, you are expressing your interest in acquiring the artwork. No payment is made through the website.
Before an invoice is issued, the artwork, purchase price, delivery method, shipping costs and, where applicable, customs duties, import taxes or other destination-related charges will be discussed and agreed with you.
An invoice is issued only after the purchase and delivery details have been agreed.
Each BIEZAART artwork is an original work of art, individually created by Anda Bieza. Many works contain delicate or fragile elements and therefore require careful handling, professional packaging and appropriate transportation.
These terms are intended to make the purchasing and delivery process clear and straightforward for both the collector and the artist.

PURCHASE TERMS FOR ORIGINAL ARTWORKS

1. Original Artworks

All artworks offered through BIEZAART are original works created by artist Anda Bieza.
Each original artwork is unique. Colours, textures and other visual details may appear slightly different depending on the screen or device used to view the artwork.
Unless expressly stated otherwise, the purchase concerns the physical original artwork described and shown on the website.
The purchase of an original artwork does not transfer copyright or other intellectual property rights to the collector. Copyright remains with the artist unless expressly transferred by a separate written agreement.

2. How the Purchase Process Works

The purchase process is personal and does not take place through an online checkout system.
The process is as follows:
1. Inquire to Purchase
If you are interested in an artwork, click “Inquire to Purchase” and submit your inquiry through the website.
Submitting an inquiry does not constitute a completed purchase and does not require payment.
2. Personal Confirmation
The artist will contact you to confirm the artwork's availability and discuss the purchase details.
3. Delivery and Additional Costs
Before the purchase is confirmed, the delivery destination and shipping method will be discussed.
Depending on the destination, additional costs may apply, including shipping, customs duties, import taxes, customs clearance fees or other charges.
These costs will be clarified and agreed with the collector before the invoice is issued, where they can reasonably be determined in advance.
4. Invoice
Once all relevant details have been agreed, an invoice will be issued.
The invoice will specify the agreed artwork price and any additional amounts payable to BIEZAART in connection with the purchase and delivery.
5. Payment
Payment is made by bank transfer according to the issued invoice.
No payment is made through the BIEZAART website.
6. Preparation and Shipment
The artwork will be prepared and dispatched after the invoice has been paid in full, unless another arrangement has been agreed in writing.

3. Artwork Price

The artwork price shown on the website refers to the artwork itself unless otherwise stated.
For international purchases, the final amount payable may also include delivery costs and other applicable charges depending on the destination country.
The final purchase and delivery arrangements will be confirmed with the collector before the invoice is issued.

DELIVERY, CUSTOMS & IMPORT INFORMATION

4. Shipping

Each artwork is carefully prepared and securely packaged for transportation.
The shipping method will be agreed with the collector according to the artwork, destination and other relevant circumstances.
Estimated delivery times are provided in good faith and may vary due to the destination, carrier, customs procedures, weather, public holidays or other circumstances outside the artist's reasonable control.
The collector is responsible for providing a complete and accurate delivery address and any information reasonably required for successful delivery.

5. Customs Duties, Import Taxes and Other Charges

International shipments may be subject to import VAT, customs duties, customs clearance fees or other charges imposed by the destination country.
Such charges are determined by the authorities or service providers in the destination country and are outside the artist's control.
Unless expressly agreed otherwise in writing, charges imposed by the destination country are the responsibility of the collector.
Where such costs are known or can reasonably be estimated in advance, they will be discussed with the collector before the invoice is issued.
BIEZAART cannot guarantee the amount, calculation or treatment of customs duties, import taxes or other charges imposed by the destination country.
Any customs duties, import taxes or other charges paid directly by the collector to customs authorities, carriers or customs agents are not payments received by BIEZAART and are therefore outside the artist's control.

6. Delivery Problems

If a shipment is delayed, held by customs or otherwise affected by circumstances outside the artist's reasonable control, BIEZAART will provide reasonable assistance and information where possible.
The artist is not responsible for delays caused by customs authorities, incorrect information provided by the collector, the collector's failure to accept or collect the shipment, or other circumstances outside the artist's reasonable control.
If additional reasonable costs arise because a shipment cannot be delivered due to an incorrect address, failure to collect the shipment or other circumstances attributable to the collector, such costs may be charged to the collector where permitted by applicable law.

RETURNS AND RIGHT OF WITHDRAWAL

7. Statutory Right of Withdrawal

Where a purchase constitutes a distance contract with a consumer, the consumer may have a statutory right to withdraw from the contract within the period provided by applicable law.
For ordinary goods purchased under a distance contract, this period is generally 14 days from the day on which the consumer or a person designated by the consumer, other than the carrier, receives the artwork.
This right does not apply to goods made according to the consumer's specifications or clearly personalised, where the applicable legal exception applies.
Nothing in these terms limits or excludes any mandatory consumer rights that cannot legally be excluded.

8. Returning an Artwork

If the statutory right of withdrawal applies and the collector decides to exercise it, the collector must notify BIEZAART within the applicable statutory period and return the artwork in accordance with the applicable legal requirements.
Because BIEZAART artworks are original works of art and may contain delicate or fragile elements, the artwork must be handled and packaged with particular care.
The collector is responsible for the direct cost of returning the artwork unless applicable law provides otherwise.
The collector should use the original packaging whenever possible.
If the original packaging is no longer available, the collector must use suitable packaging that provides reasonable protection for the artwork during transportation.
The collector is strongly advised to photograph the artwork and the packaging before sealing the parcel and to use a trackable shipping service with appropriate insurance where reasonably available.

9. Reimbursement

Where a statutory right of withdrawal applies, BIEZAART will reimburse payments received from the consumer in accordance with applicable law.
Where applicable, this includes the cost of the least expensive standard delivery method offered by BIEZAART. Additional costs resulting from the consumer's choice of a more expensive delivery method are not required to be reimbursed where permitted by law.
BIEZAART may withhold reimbursement until the artwork has been received back or the consumer has provided evidence of having sent the artwork back, whichever occurs first, as provided by applicable law.
BIEZAART will not be responsible for customs duties, import taxes, customs clearance fees or other charges that were not received by BIEZAART and were paid directly to authorities, carriers or other third parties.

10. Condition of a Returned Artwork

The collector may examine the artwork to establish its nature, characteristics and condition.
The collector must not handle, use, display, modify, alter, clean, repair or otherwise treat the artwork beyond what is reasonably necessary for such examination.
If the artwork is returned damaged, altered, incomplete or with a diminished value because it has been handled beyond what is necessary to examine its nature, characteristics and condition, the collector may be liable for the resulting diminished value to the extent permitted by applicable law.
This includes damage caused by inadequate handling, unsuitable storage, improper installation, inappropriate packaging or insufficient protection during return transportation, where such damage is attributable to the collector.
Any diminished value will be assessed based on the actual condition of the artwork upon its return and the reasonable cost or extent of restoration or other loss resulting from the damage.
The collector is strongly advised to retain the original packaging until the purchase is fully concluded.

DAMAGE, NON-CONFORMITY AND COMPLAINTS

11. Damage During Delivery

If an artwork arrives with visible damage, the collector should, where reasonably possible, photograph the package before opening it.
After opening the package, the collector should photograph the packaging materials, shipping label and artwork, including any visible damage.
Please contact BIEZAART as soon as reasonably possible and provide the photographs and a description of the damage.
This information is important for documenting the condition of the shipment and, where applicable, communicating with the carrier or insurer.
Nothing in these terms limits any mandatory statutory rights relating to damaged or non-conforming goods.

12. Non-Conformity

If the artwork does not conform to the purchase agreement or has a defect for which the artist is legally responsible, the collector retains all mandatory statutory rights available under applicable law.
The appropriate remedy will be determined in accordance with the applicable legislation and the circumstances of the individual case.
The collector should contact BIEZAART as soon as reasonably possible after discovering an issue so that the matter can be assessed and resolved appropriately.

COPYRIGHT AND USE OF THE ARTWORK

13. Copyright

All copyright and other intellectual property rights in the artwork remain with Anda Bieza unless expressly agreed otherwise in writing.
Purchase of the physical artwork does not transfer copyright.
The collector may own, display and enjoy the physical artwork, but may not reproduce, copy, commercially exploit, manufacture copies of, license, sell reproductions of or otherwise commercially use the artwork without the artist's prior written permission, except where such use is permitted by law.

BUSINESS AND GALLERY PURCHASES

14. Business Purchases

Where the purchaser is acting for purposes relating to their business, profession or commercial activity, the transaction may be treated as a business-to-business transaction.
Consumer-specific rights apply only where the purchaser qualifies as a consumer under applicable law.
For gallery, corporate or other professional purchases, the applicable purchase, delivery and payment terms may be agreed separately in writing.
The applicable tax treatment and documentation will be determined according to the relevant legislation and the circumstances of the transaction.

GOVERNING LAW

15. Applicable Law

These terms are governed by the laws of the Republic of Latvia, except where mandatory consumer protection provisions of the collector's country of residence apply.
If a question or dispute arises, BIEZAART encourages the collector to contact the artist first so that the matter can be resolved directly and reasonably.
Nothing in these terms limits any mandatory rights or remedies available to consumers under applicable law.

This Privacy Policy explains how Anda Bieza, artist and creator of original artworks, processes and protects personal data when you contact BIEZAART, submit an artwork inquiry or purchase an original artwork.

Where necessary, personal data may also be retained for the period required to establish, exercise or defend legal claims.

If an artwork is shipped outside the European Union, certain information may need to be provided to delivery companies, customs authorities or customs agents in connection with the shipment.
Any personal data transfer outside the European Economic Area will be carried out in accordance with applicable data protection requirements.
